NOTICE OF TRUSTEE'S SALE OF CERTAIN PROPERTY LOCATED IN THE CITY OF DANVILLE, VA, AND DESIGNATED AS 340 BARRETT STREET, DANVILLE, VIRGINIA PARCEL ID NO. 56122 In execution of a Credit Line Deed of Trust from George I. McDowell, Sr., dated August 27, 2008, recorded September 2, 2008, as Instrument No. 080003466, at page 24, in the Clerk's Office of the Circuit Court of Danville, Virginia (the "Deed of Trust"), the Trustee, Clement & Wheatley, a Professional Corporation, having been requested to do so, will offer for sale at public auction, at the main entrance to the Danville Circuit Court located at 401 Patton Street, Danville, Virginia, at: 10:00 a.m., August 10, 2020 (the "Sale Date") the following described property with improvements thereon (the "Property"), situate, lying and being in the City of Danville, Virginia, and being described as follows: All that certain lot or parcel of land, together with improvements there on and appurtenances thereunto belonging, situate in the City of Danville, Virginia, having been annexed from Pittsylvania County on July 1, 1951, and more particularly described as follows: LOT NOS. 50, 51, AND 52, fronting a total of 75 feet on the northwestern margin of Barrett Street, as shown on Map of Dan Heights for E.U. Boggs, dated December 28, 1943, made by H.S. Peirce, Surveyor, of record in the Clerk's Office of the Circuit Court of Pittsylvania County, Virginia, in Map Book O, at page 35, now Map Slide 1-244F; and being, the same property conveyed to George I. McDowell and Clara M. McDowell, by deed dated September 18, 1972, from W.W. Jones, of record in the Clerk's Office of the Circuit Court of the City of Danville, Virginia, in Deed Book 513, at page 385; to which map and deed references are here made for a more particular description of the property herein conveyed. Clara M. McDowell died on January 11, 1990, leaving as her sole heir at law, her husband, George I. McDowell; reference is made to her list of heirs of record in Will Book 71, at page 22. This sale is subject to all conditions, restrictions, reservations, declarations, easements, leases and rights-of-way of record or contained in the deeds forming the chain of title to the Property, and subject to any and all prior liens, including, but not limited to recorded and unrecorded mechanics' and materialmens' liens, if any. WARRANTIES: THE PROPERTY AND ALL THE IMPROVEMENTS LOCATED THEREON WILL BE SOLD IN THEIR "AS IS" CONDITION WITHOUT WARRANTY OF ANY KIND. TERMS OF SALE: ALL CASH. Purchaser shall pay for all recording charges (EXCLUDING Grantor's Tax), examination of title, settlement fees and all costs of conveyancing. Transfer of title of the Property to the purchaser shall be by special warranty deed of bargain and sale. To bid on the Property, each bidder, other than the Noteholder, shall qualify as a bidder by demonstrating to Trustee prior to bidding the ability of such bidder to satisfy deposit requirements immediately upon acceptance of a bid by delivery to Trustee of deposit IN CASH or by CERTIFIED or CASHIER'S CHECK of $4,000.00, or 10% of the sale price, whichever is lower. Unless otherwise agreed to in writing, settlement in full shall be made within 30 days from the date of the sale. Taxes will be pro-rated to the date of the sale. If the Trustee fails to convey title to the Property to the Purchaser, the Purchaser's sole remedy is return of the deposit. Delivery of possession of the Property will be the responsibility of the purchaser. The Purchaser will be required to execute a Memorandum of Sale containing terms and conditions relating to sale and the purchase of the Property, a copy of which will be available immediately before the sale. Trustee reserves the right to amend the terms of the sale by announcement prior to sale, modify requirements for bidder qualification/deposit, and/or withdraw all or part of the Property as Trustee may determine appropriate in its sole discretion.
